1. Who we are and acceptance
These Terms and Conditions (the "Terms") are an agreement between you and CBT Labs, LLC, a limited liability company organized in the State of Delaware, United States ("CBT Labs", "we"). They govern access to the cbtlabs.co site, the application at app.cbtlabs.co and any related service (together, the "Service"). You can reach us at hello@cbtlabs.co.
By creating an account, connecting a Mercado Libre account or using the Service, you accept these Terms and the Privacy Policy.
The Service is intended for sellers operating as businesses or professionals, aged 18 or older. If you accept these Terms on behalf of a company, you represent that you have authority to bind it, and "you" refers to that company.
2. What CBT Labs does and does not do
CBT Labs is a tool for Mercado Libre Global Selling sellers. Depending on the plan, the Service can:
- Pull a product's title, images, attributes and dimensions from Amazon, starting from its ASIN.
- Create listings on Mercado Libre in Mexico, Argentina, Brazil, Chile and Colombia, with titles and descriptions adapted to each country with the help of artificial intelligence.
- Calculate the price in US dollars with the margin, taxes and logistics costs you configure.
- Check price and availability on Amazon daily, update your listings and pause them when a product runs out of stock.
- Read your orders, shipments and fees to show you your sales and their profitability.
2.1. What belongs to the seller
CBT Labs is not a marketplace and does not take part in your business operations: it does not buy products, transport, import, ship, charge your buyers or handle their claims. Buying on Amazon or from another supplier, shipping to your logistics warehouse, complying with the Global Selling program, buyer support, returns and your tax and customs obligations belong to the seller.
CBT Labs does not suggest, recommend or select products. The lists we show, such as Amazon best sellers, are public information sorted by the filters you choose; what to publish, in what quantity and at what price is always your decision.
CBT Labs is not affiliated with, sponsored by or endorsed by Mercado Libre or Amazon. Those brands belong to their owners and are mentioned only to identify the services the Service connects to.
3. Your account
You can create your account with an email and password or by signing in with Google. You are responsible for the accuracy of its information, for keeping your credentials secret and for what happens under your account, including what the people you give access to do. Let us know right away if you suspect unauthorized access.
From your profile you can review your active sessions, close the others and delete your account.
If you ask us for help with your account, the CBT Labs team may access it solely to handle your request. Actions we take at your request are considered taken by you, and you can withdraw that access at any time.
4. Connection with Mercado Libre
The connection uses Mercado Libre's official authorization. We never see or store your password. The authorization lets us operate listings, orders and shipments on your behalf, and we use it only for the features you use.
Your first listings are made with the shared CBT Labs application. Once that quota is used, you connect your own Mercado Libre DevCenter application and provide its credentials, which we store encrypted and use only to operate your account.
You can revoke the connection at any time, from the Service or from Mercado Libre. Doing so stops publishing and updating; listings that are already live are not taken down.
Mercado Libre can change its rules, interfaces and requirements at any time. We will do our best to adapt, but some changes may temporarily limit what the Service can do.
5. Risks inherent to selling on Mercado Libre
By signing up and using the Service, you understand and accept that the risk on your Mercado Libre account is yours. You decide what you publish, and that decision may not comply with the policies of Mercado Libre or of a destination country, for example in the case of regulated or prohibited products or protected brands.
Our lists of blocked brands, words and categories and our test mode exist to help you reduce violations as much as possible, but they cannot guarantee that you will not receive violations or that your account will not be limited or suspended. You can edit those lists: you can remove items and publish what you decide.
Decisions about listing moderation, violations, reputation, withholdings and suspensions belong solely to Mercado Libre, and CBT Labs does not assume responsibility for them or their consequences. We ask you to keep this in mind before using the Service.
Publishing many products in a short time, especially on new accounts or accounts with little reputation, may lead to verifications or limits by Mercado Libre. You decide how much, what and when to publish.
6. Amazon data and prices
Prices, availability, weights, dimensions and delivery times come from Amazon and may change between one check and the next, be inaccurate or be unavailable. The price we calculate depends on that data and on your margin, tax and logistics settings.
We recommend verifying the actual cost before buying for each sale. CBT Labs is not responsible for sales made below cost, negative margins or misestimated shipping costs or weights.
7. Content generated with artificial intelligence
Titles, descriptions and translations may be generated by language models. They are a starting point and may contain errors, omissions or claims that do not apply to a specific market, so we recommend reviewing them before publishing. They are not legal, tax or customs advice.
8. Your catalog and your content
Everything you upload or connect β products, images, descriptions, prices, costs and sales data β remains yours. You grant us a limited, non-exclusive license to store, reproduce, translate, adapt and transmit that content solely to provide the Service to you.
You represent that you have the rights needed to sell each product and use its images, brands and descriptions. We may use aggregated statistics that do not identify you to improve the Service.
9. Plans, SKU quota and test mode
Each plan is a monthly subscription that sets how many SKUs you can have active at the same time (your "credits"). A SKU takes one credit whether you publish it in one country or in all five. Credits are not a monthly allowance that gets used up: they are freed when you stop managing a SKU.
With an active plan, each active SKU within your quota is checked on Amazon and updated on Mercado Libre once a day. We do not guarantee a specific time, and updates depend on Amazon and Mercado Libre being available.
You can upgrade at any time; the change applies and is charged immediately. If you downgrade, the change applies at the end of the period, and SKUs above the new quota are put on hold.
Test mode publishes to a Mercado Libre test account so you can check the result before going live. Each test listing takes one credit, just like a real one. It is a way to reduce errors and violations, not a guarantee that the real listing will be accepted.
10. Free trial and launch promotional prices
The 1K Plan includes a 30-day free trial. We ask for a card at the start but charge nothing until the trial ends; if you cancel before, you are not charged. The free trial is one per Mercado Libre account.
During the launch beta, plans have promotional prices: they are the prices shown at sign-up and the ones charged each month. Promotional prices are valid until December 31, 2027. Before they end, we will give you advance notice of the prices that will apply from January 1, 2028, which will also apply to plans already in place.
11. Payments and cancellation
Plans are charged monthly in advance through Stripe and renew automatically until you cancel. Prices are in US dollars and do not include taxes or bank fees that may apply in your country. CBT Labs does not store your card number.
You can cancel yourself at any time, without talking to anyone: in the application, under Plans and packages β Manage plan β Cancel plan. Your plan stays active until the end of the paid period and the next one is not charged.
If a renewal charge fails, we will retry it for a few days and let you know so you can update your card. If it is not completed, the account is suspended until the outstanding invoice is paid.
When the plan expires, is canceled or is suspended, we stop updating the price and stock of your listings, but we do not pause or modify them: they remain active on Mercado Libre with the latest data. If you do not want to keep selling them, you can pause them from Mercado Libre.
If we change plan prices, customers with an active plan keep their price as long as they keep it without interruption; new prices apply to new subscriptions. This does not cover the end of the launch promotional prices, which is governed by section 10.
If you start a chargeback or dispute with your bank over a CBT Labs charge, the plan will be suspended while it is resolved. We ask you to write to hello@cbtlabs.co first: most billing issues are solved quickly.
12. Refunds and plan transfer
Plans are not refundable. We understand that a change of plans, a period without use or sales, difficulties with Amazon, logistics or your buyers, or changes at Mercado Libre may happen; in those cases a refund does not apply, although you can always cancel the renewal so no new charges are made.
Sole exception: if Mercado Libre permanently suspends the account linked to your plan, for any reason, you can request a refund of the days remaining from the date of your request to the end of the paid period. You must request it at hello@cbtlabs.co before the period ends; days before the request are not refunded, because the Service kept updating your products during them. A temporary suspension, a pause or a limitation of the account does not entitle you to a refund.
If Mercado Libre suspends your account, temporarily or permanently, you are entitled to ask us to move your active plan to another Mercado Libre account connected to CBT Labs. The transfer keeps the plan's quota, expiration date and any outstanding payments.
13. Acceptable use
When using the Service you agree not to:
- Publish counterfeit, illegal, stolen or prohibited products in the destination country.
- Infringe trademarks, copyrights or third-party rights.
- Circumvent Mercado Libre limits, quotas or rules, or use the Service to abuse its APIs.
- Share your account, resell access or use the Service to operate other people's accounts without authorization.
- Try to access parts of the system that are not yours, extract other customers' data or interfere with the availability of the Service.
- Create accounts with false information or repeat the free trial with the same Mercado Libre account.
14. Third-party services and availability
The Service depends on platforms we do not control, such as Mercado Libre, Amazon and our infrastructure, payment and artificial intelligence providers. Their changes or outages may affect what the Service can do.
We do our best to keep the Service available, although we do not commit to a specific level of availability. We may change or withdraw features with reasonable notice; if a change substantially reduces what you subscribed to, you may cancel and request a refund of the remaining days.
15. Intellectual property
CBT Labs' software, interface, brand and documentation belong to CBT Labs or its licensors. These Terms give you a limited, revocable and non-transferable right to use the Service, without transferring any ownership. You may not copy, decompile or create derivative works of the Service, except where the law allows it.
16. Suspension and termination
You can stop using the Service and delete your account at any time from your profile. Deleting it ends your active plan, without a refund, and your data is handled as described in the Privacy Policy.
We may suspend or close an account that breaches these Terms, puts the Service or other customers at risk, or that we must close because the law or Mercado Libre requires it. Whenever possible, we will notify you first and give you the chance to correct the situation.
Sections that by their nature should survive remain in effect after the agreement ends: intellectual property, warranties, limitation of liability, indemnification and governing law.
17. Warranties
Except as stated in section 9, the Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no implied warranties of merchantability, fitness for a particular purpose or non-infringement.
We do not guarantee sales, revenue, margins, rankings, listing approval or the absence of violations. Examples and figures on our site are illustrative and do not promise results.
18. Limitation of liability
To the fullest extent permitted by law, CBT Labs is not liable for indirect, incidental, special or consequential damages, lost profits, lost sales, loss of data or reputation, or penalties or withholdings imposed by Mercado Libre, Amazon or authorities.
Our total liability for any claim related to the Service is limited to the amount you paid CBT Labs in the twelve months before the event giving rise to it. Nothing here limits liability that cannot be limited by law.
19. Indemnification
You agree to hold CBT Labs harmless from claims, losses and expenses β including reasonable attorneys' fees β arising from your content, your products, your sales, your use of the Service or your breach of these Terms or of Mercado Libre's rules.
20. Changes to these Terms
We may update these Terms. If a change is substantial, we will notify you by email or in the application at least 15 days before it takes effect. If you disagree, you can cancel before that date; continuing to use the Service afterwards means you accept the new version.
21. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
If a disagreement arises, we will first try to resolve it in good faith by email for 30 days. If it is not resolved, it will be submitted to individual arbitration administered by the American Arbitration Association under its commercial rules, seated in Wilmington, Delaware, before a single arbitrator, in Spanish or English. Either party may go to court for urgent relief or small claims.
Nothing above removes the rights that the law of your country of residence grants you and that cannot be waived by agreement.
